- Active services
- Communication history
- Fees & Payment Payment Terms: – All services must be paid in advance at the time of ordering or renewal. – Accepted Payment Methods: Most major credit, debit, or prepaid cards are accepted. Billing Details: – An active payment method is required to maintain your account and services. – Failure to maintain an active payment method may result in service interruptions or loss of domain names, emails, SEO rankings, or data. – 911MYWEB is not liable for losses due to missed payments or failed automatic transactions. Payment Information and Security We use a secure bank merchant account to process credit card payments. When you provide your credit card information, it is securely transmitted to the payment processor and stored according to PCI-compliant security standards. We do not store your full card details on our servers. Instead, we retain a token provided by the payment processor to facilitate future payments. By using our services, you consent to the processing and storage of your payment information by the merchant in accordance with their privacy policy. – This default method will be used for all future charges unless changed in the client portal. Failure to Pay: – If a payment is not processed successfully, we will attempt to use other saved payment methods. – Services may be suspended or terminated if payments are not received. reactivation fees of $75.00 may apply for reactivating services. Refund Policy: – All payments are non-refundable, including overdue or delinquent amounts. – If a refund is authorized, it will be processed within 15 business days to the original payment method. Automatic Payments: – Services with recurring fees (monthly, quarterly, or annually) will auto-renew using the saved payment method. – Users can update the default payment method through the client portal.
- Abandonment, Suspension, and Termination Policy Failure to Maintain Payments and Service Responsibilities It is the client’s responsibility to ensure timely payment of all fees associated with hosting, maintenance, domain renewals, or other services provided by 911MYWEB. Failure to meet these obligations may result in account suspension or termination, including the removal of the website and data from our servers. ● Account Suspension: ○ If the client fails to pay for services by the due date, the account may be suspended. ○ Suspended or accounts that are Overdue will have limited access to the website, client portal, and services until all outstanding payments are resolved. ● Termination of Account and Deletion of Data: ○ If the account remains unpaid or abandoned for 30 days or more, 911MYWEB reserves the right to terminate the account. ○ Upon termination, all website data, configurations, and settings may be permanently deleted from our servers. This deletion may result in the loss of all files, data, and configurations, which may not be recoverable. ○ 911MYWEB is not responsible for any data loss resulting from termination due to non-payment. ● Notice of Termination: 911MYWEB will make reasonable efforts to notify clients of unpaid balances before termination through email or the client portal. However, failure to receive notice does not exempt the client from payment obligations. ● Restoration Fees: If the client wishes to restore services after account termination, a restoration fee of $150.00 may apply, provided the data is recoverable. Restoration is not guaranteed if the data has been deleted.
- Password Policy for Web Development and Hosting Client Responsibility for Password Management ● Client Control: The client is solely responsible for the safe storage and security of all passwords associated with their website, hosting, and any other services provided by 911MYWEB. ● Requesting Passwords: The client may request their current passwords at any time through our official support channels, provided proper verification is completed. Password Resets ● Manual Password Reset: Password resets will only be processed manually upon request if automated reset options are unavailable. ● Verification Requirement: Clients must provide adequate identification or proof of account ownership for manual password resets to protect account security.
- Post-Completion Website Maintenance and Compatibility PolicyClient Understanding of Future Service Needs
● Ongoing Compatibility: The client acknowledges that, over time, the website may require additional services to maintain full functionality and visual optimization across new devices, including but not limited to computers, monitors, smartphones, tablets, and other emerging technologies.
● Optional Future Services: Any updates or optimizations required for compatibility with new hardware, operating systems, or display resolutions will be available upon request and may incur additional fees. 911MYWEB’s Responsibility and Update Limitations
● Completion Warranty: 911MYWEB guarantees the website’s structure and performance for 30 days following the completion of development. After the 30-day period, the client assumes full responsibility for monitoring and maintaining the website’s performance.
● Exclusion of Graphic and Structural Updates: After the guaranteed period, 911MYWEB is not responsible for performing free updates or modifications to the website’s graphics, structure, or layout unless under a separate maintenance agreement. Client Responsibility for Ongoing Monitoring and Updates
● Monitoring for Issues: The client is responsible for monitoring the website for outdated content, disruptions, or performance issues caused by security patches, platform updates, or the release of new hardware and software.
● Impact of Updates and Market Changes: Clients acknowledge that new device versions, browsers, and software updates may affect how the website displays or functions over time, and additional services may be required to resolve these issues.
● Request for Services: If disruptions arise, the client may request troubleshooting, optimizations, or updates from 911MYWEB, which will be billed separately according to the scope of work required. Repairs Made by Clients or Third Parties 911MYWEB is not responsible for any damage, disruptions, or malfunctions caused by:
- Changes or repairs made by the client.
- Work performed by third parties, including subcontractors, personal hires, or individuals granted access by the client.
- Unauthorized modifications to the website or server configuration made by anyone other than 911MYWEB personnel.
- Professional Services for Damage Investigation ● Optional Investigation Service: If damage occurs and the client requests an investigation, 911MYWEB offers professional services to determine the cause of the issue. ● Service Fees: Investigation and troubleshooting services will incur additional fees, which must be agreed upon before any work is initiated. ● No Guarantee of Repair: While 911MYWEB will make reasonable efforts to investigate and advise on potential solutions, we do not guarantee that all issues can be resolved, particularly if caused by third-party modifications.
- Website Restoration Policy After Termination Restoration Fees and Conditions If a client’s account is terminated due to non-payment, abandonment, or other violations of these Terms, the following restoration conditions apply: ● Web Restoration Fee: A non-refundable fee of $150.00 will be charged to restore the website if a backup is available. ● Backup Availability: Restoration is only possible if a recent backup exists. If no backup is available, 911MYWEB is not responsible for any lost data, and the restoration will not be possible. Process and Timeline ● Requesting Restoration: The client must submit a written request for restoration via the client portal or official support channels. ● Processing Time: Restoration requests will be processed within 5-7 business days from the time of payment, subject to the availability of backups. ● Additional Fees for Custom Work: If further reconfigurations or repairs are required beyond standard restoration, additional fees may apply, and the client will be notified in advance. No Guarantee of Complete Recovery While 911MYWEB will make reasonable efforts to restore the website, there is no guarantee that all data, settings, or customizations will be recoverable. Clients acknowledge that some data or content may be lost, especially if the termination has resulted in partial or full deletion from the servers.
- 20. Website Transfer Restriction Policy Transfer Rights and Outstanding Fees ● Ownership and Hosting Transfer Conditions: While the client owns the website and its content after full payment, 911MYWEB reserves the right to withhold or restrict the transfer of the website (including files, code, and configurations) to another hosting provider if there are outstanding hosting fees or any other unpaid service charges. Hosting Fees Must Be Current ● If the client maintains hosting services with 911MYWEB, all hosting fees and other service payments must be up-to-date before any transfer request can be processed. ● Suspension of Transfer Requests: Any request to transfer the website to a third-party hosting service will be denied if there are unpaid balances on the client’s account. Restoration of Transfer Rights Upon Payment ● Once all outstanding fees are paid in full, 911MYWEB will release the website files for transfer within 5-7 business days and provide any necessary assistance to complete the process. ● No Transfer Liability: 911MYWEB is not responsible for any issues or data loss that occur during or after the transfer to a new hosting provider. Non-Refundable Hosting Fees ● Hosting fees already paid are non-refundable, even if the client decides to transfer the website before the end of the current billing cycle.
- Copyright Transfer Policy All copyrights for the services, designs, code, and other work performed by 911MYWEB will be transferred to the client upon completion of 100% payment for the service. ● Full Ownership Rights: Once the final payment is made, the client gains exclusive ownership of all deliverables, including any website content, code, and graphic designs created by 911MYWEB. ● Transfer Scope: This transfer grants the client the right to use, modify, and distribute the content without restrictions, subject to any third-party licenses incorporated into the project (e.g., plugins or stock imagery). ● Retention of Rights Prior to Final Payment: Until the full payment is received, 911MYWEB retains all ownership rights to the work and deliverables.
- Software Development and Licensing Policy License Model for Proprietary Code All software development and proprietary code created by 911MYWEB as part of your project is provided under a limited license. This license grants you, the client, the right to use the software and code exclusively for the domain name and project for which it was developed. License Restrictions ● No Resale or Sublicensing: You are not entitled to resell, distribute, or sublicense the software, code, or any other work developed by 911MYWEB without prior written consent explicitly outlined in a separate agreement. ● Single-Use License: The license covers only the specific domain associated with the project. Any additional use on other domains or projects requires a separate agreement and may incur additional licensing fees. ● Ownership of Code: While the code is provided under license for your use, 911MYWEB retains ownership of the proprietary code unless otherwise stated in a mutually signed agreement. Amendments to License Terms Any changes to the licensing terms, including permissions to resell or sublicense the developed code, must be expressly agreed upon in writing and outlined in a separate agreement attached to or referenced by these Terms.
- Software Development and Licensing License Model for Proprietary Code All software development and proprietary code created by 911MYWEB as part of your project is provided under a limited license. This license grants you, the client, the right to use the software and code exclusively for the domain name and project for which it was developed. - Logo Design and Branding Design Process 911MYWEB will create a logo based on the client’s requirements using either a handcrafted design or a template-based orientation. The final design will reflect the agreed-upon concept and direction provided by the client. Trademark Disclaimer ● No Guarantee of Trademark Registration: 911MYWEB does not guarantee that the logo will successfully be registered as a trademark. ● Legal Consultation Recommended: It is the client’s responsibility to seek legal counsel to conduct a personalized trademark search or obtain legal advice regarding potential trademark conflicts. Revision Policy ● Included Revisions: The initial logo design includes up to three (3) revisions. ● Additional Revisions: Any revisions beyond the three included will be considered excessive and may incur additional fees. ● Redesigns: If the client requests a redesign or significant changes outside the original scope, it will be treated as a new service subject to separate fees. Copyright and Ownership Transfer ● Copyright Release Upon Full Payment: Once the client completes the full payment for the logo project, 911MYWEB will transfer all copyrights associated with the logo to the client. ● Ownership Rights: The client will have full ownership of the logo design and may use it as they see fit. ● Design Credit (Optional): 911MYWEB may request, but does not require, design credit to be attributed for the work. The client has the right to decline providing design credit.
- SMTP Service.
1. Purpose of SMTP Services The Simple Mail Transfer Protocol (SMTP) is essential for websites to send notifications, order confirmations, and form submissions via email. This applies to websites offering basic web presence or e-commerce functionalities. SMTP ensures smooth communication between the website and its users, administrators, and customers by delivering notifications promptly. Key uses of SMTP include:
- Order confirmations and notifications for online stores.
- Contact form submissions to administrators.
- Account creation, password resets, and other transactional emails.
- Purchase an email service from 911MYWEB for dedicated SMTP purposes.
- Provide a compatible SMTP service linked to the same domain used for the website to ensure smooth delivery.
- Regularly monitor the SMTP service to ensure it remains active and configured correctly.
- Ensure that SMTP credentials (username, password, and host information) are always up to date.
- Check email quotas and limits with their provider to prevent message delivery failures.
- Use trusted email service providers to ensure compliance with SMTP protocols and avoid disruptions.
- Ensure the SMTP service is properly configured with the new hosting provider.
- Maintain ongoing access to email services to prevent interruptions.
- Use secure SMTP protocols (SSL/TLS) to protect emails from being intercepted.
- Implement rate limiting on outgoing emails to prevent the service from being flagged as spam.
- Verify that the SMTP server complies with anti-spam and email authentication protocols (such as SPF, DKIM, and DMARC) to ensure successful email delivery.
- Website and E-commerce Design and Development Scope of Services 911MYWEB offers website and e-commerce design and development services tailored to the client’s requirements. Services may include, but are not limited to:
- Custom website design and development.
- E-commerce platform setup and configuration.
- Integration with payment gateways, shipping services, and third-party tools.
- Mobile responsiveness and cross-browser compatibility.
- Initial SEO optimization (basic metadata setup).
- SMTP Account Setup
- Payment Installment Agreement 1. Client Responsibility for Full Payment ● Upon making the initial installment payment, the client acknowledges and agrees that they are fully responsible for the total amount of the service, regardless of any changes made during the project or cancellation requests after the service has begun. 2. Difference Between Full Payment and Installment Price ● The difference between the full payment price and the installment payment price reflects only the payment structure and does not include any financial charges, interest, or percentage-based fees. ● No Interest or Financial Charges: The installment payment option provides an extended payment period without interest or financing fees. 911MYWEB affirms that no intent exists to charge interest or financial charges through the installment plan. ● Full Payment Discount: Clients who choose to pay in full benefit from a discounted price for the service compared to those using the installment plan. 3. No Eligibility for Special Promotions ● Installment plan clients are not eligible for special promotions or discounts available only to full-payment clients. However, they benefit from the extended payment period without incurring additional charges or interest. 4. Non-Cancellation and Payment Obligation ● Obligation to Complete Payments: Clients using the installment plan remain obligated to complete all scheduled payments in full, even if they decide to cancel the service or alter the project’s scope during the installment period. ● No Refunds or Cancellations: Canceling the project or making scope changes will not release the client from the obligation to pay the full amount as agreed under the installment plan.
- Client Rights to Hosting and Transfer Policy 1. Development Hosting on 911MYWEB Servers – During the development process, the website will be hosted exclusively on 911MYWEB servers or partner servers, such as TIPIHOST.com. – Limited Access During Development: To ensure the proper completion of the development, 911MYWEB reserves the right to limit access to the website until the project is finalized. This restriction helps maintain security and prevent disruptions during the design and development stages. 2. Complimentary Hosting and Services – 30-Day Complimentary Hosting and Management Services: Clients will receive 30 days of credit for the following services: – Managed Web Hosting – Secure Server Layer (SSL) Management – SMTP Email Service – Technical support to facilitate smooth development. – This complimentary period is intended to provide unrestricted hosting during the development process. 3. Hosting Obligations Beyond Development Period – Client Responsibility for Hosting Payment: After the 30-day complimentary period, the client is responsible for ongoing hosting payments, as outlined in the project proposal. Hosting fees will apply even if development extends beyond the initial time frame. 4. Post-Development Hosting and Transfer Options – Upon project completion, the client may choose to: 1. Continue hosting with TIPIHOST.com and receive a 90 -day extended warranty for fixes and updates. 2. Transfer the website to another hosting provider of their choice. – Warranty Limitation on Transfer: If the client transfers the website to a third-party hosting provider (other than TIPIHOST.com), the 90-day extended warranty will be voided on the day of transfer. 5. Conditions for Website Transfer – Final Payment Requirement: The client must complete all payments in full for the web development service before any transfer occurs. – Hosting and Service Status: All associated services, including web hosting, email services, and SSL certificates, must be active and in good standing, with no past-due or overdue payments. 6. Transfer Process and Credentials Delivery – Credentials for Transfer: Transfer credentials will be provided within 48 hours of receiving the final payment, provided the client’s account is in good standing. – No Liability Post-Transfer: Once the transfer to another provider is complete, 911MYWEB is no longer responsible for maintaining or troubleshooting the website.
- Intellectual Property Rights The content, software, and other materials available on the site (referred to as “Site Content”) are owned by 911MYWEB or its licensors and are protected under copyright, patent, trademark, and other intellectual property laws in the U.S. and internationally. ● You agree not to modify, distribute, publish, or license the content for commercial or public use without prior permission. ● All trademarks, service marks, and logos displayed are the property of 911MYWEB or its licensors. ● Unauthorized use of the trademarks to imply endorsement or association with 911MYWEB is strictly prohibited.
- Limited Access During Development During the development phase, 911MYWEB may restrict access to the website by placing it in maintenance mode to ensure smooth progress. However, clients can request access to review the progress as needed. Please note that the content and design seen during development are not final and may undergo further changes.
- Search Engine Management To avoid publishing incomplete or incorrect content, 911MYWEB will prevent search engines from indexing the development site until the project is complete. Upon project completion, clients can request indexing or opt-out if preferred. This helps ensure that only the final, polished version of the website is made public.
- HIPAA Disclaimer 911MYWEB does not offer services that comply with the U.S. Health Insurance Portability and Accountability Act (HIPAA). Clients needing HIPAA-compliant services must engage with certified providers. 911MYWEB does not monitor or verify HIPAA compliance and assumes no responsibility for data compliance under HIPAA standards.
- DISCLAIMER OF WARRANTIES To the fullest extent permitted by law, 911MYWEB provides the services, including all content available through the services, “as-is” without any express, implied, statutory, or other warranties.
